With today's technology, most of our cases begin by consultation via email or telephone. Most information can be obtained via these methods and we often get started on a case without even meeting the client face-to-face. Many find this type of relationship most convenient. Others prefer to meet face-to-face in one of our offices to discuss their case and begin moving forward. We welcome either opportunity and offer a complimentary 15 minute consultation to get things started in either case. How much will you pay?As you probably expect, every divorce case is different. Our firm policy is to offer flat-rate fees whenever possible, but it is sometimes impossible to predict how long and how much work a particular matter will take. In these cases, we determine an estimated approximate time that would be required to complete the case and ask for a deposit into an individual client trust account to cover the estimated charges. Most deposits in divorce cases range between $1,000 and $3,500. The amount depends entirely on the complexity of the case and the likelihood of settlement. As a general rule-of-thumb, you should understand that the better you and your spouse can work together to negotiate and agree, the cheaper the divorce will be; the more that lawyers are involved, the more it will cost. While most attorneys bank on this, we educate our clients of it and try to save them money. The happier the client, the more the referrals - that is our philosophy. (We are not too proud to ask!) One of our most popular legal services, our pro se divorce package is the perfect solution for those clients requiring divorce paperwork, guidance, and instruction without the extra expense of having an attorney represent them in full. This package is 100% created and supported by attorney Donald C. Nemec and geared toward those couples who will agree on getting divorced, dividing their property and debts, and their parenting plan (regarding custody, visitation, and support). What to expect - Step by Step 1. You complete a questionnaire that provides us with the general information we need to draft your divorce paperwork and then make payment online through our secure merchant account.
2. After you make payment, we will draft your Petition for Divorce and email it to you within 2 - 3 business days.
3. You have the option of filing your petition on your own (with our instructions) or signing the document and sending it to us to file it for you.
4. After filing the divorce petition, you must wait 60 days before you can finalize your divorce. In this interim period, we will draft the remaining paperwork required to complete your divorce - including a customized Divorce Decree that clearly states the division of your marital property and debts, your agreement regarding your children, and all other applicable details.
5. Your spouse will need to sign the Decree as well as a waiver. Once he or she signs both documents, he or she will be completely out of the picture with nothing left to do in the divorce proceeding.
6. You will go to the courthouse after 60 days have lapsed to finalize your divorce. We will not provide an attorney to attend the hearing with you, however, we will prepare you 100% for what to expect on that day - down to every detail including the exact words to say to the judge. (The hearing will last less than two minutes if you use our system. We make it easy for you.)
7. The judge will sign your Decree and your divorce will be complete. The court clerk will mail your ex-spouse a copy of the decree so you will not have to have further contact with them.
Other InformationThe statewide service is done exclusively via email and telephone. All of the work will be completed by an attorney. We do not employ any paralegals or other assistants to help with the divorces. Also, we do not run your data through a computer program to spit out your documents. Instead, we personally type out your legal forms so to ensure they are correct and customized to fit your particular needs. This service does not include mere paperwork as most flat rate do-it-yourself divorce packages do. It instead includes: - The option of having our law firm file all paperwork for you or filing it on your own (with our full instructions),
- detailed written instructions that are customized for your Texas county,
- all required customized and complete paperwork, ready to file, and
- full support throughout the process by a Texas licensed attorney.
Only one hearing is required during your divorce. It will occur in about two months after you file the divorce, is very simple, and we provide 100% support to eliminate the unknowns and intimidation. (Not that we do not attend the hearing with you, but give you complete instructions.) You and your spouse will need to come to agreement on any disputed issues before you finalize the divorce. Please note that this service does not include negotiations or mediation work. But those services are available if needed, however. How much will you pay?
As long as your spouse agrees to sign paperwork, you will only pay our low flat rate legal fee and the court filing fee (if you do not qualify to have it waived).There will be no additional fees. Legal Fee: Spouses without children: $199 + tax Spouses with children $299 + tax
Filing Fee: If you cannot afford the court costs when you file the divorce, then you will not have to pay them. Otherwise there is a filing fee of around $250 - $300 due when you file.
