About Attorney Donald C. Nemec
Mr. Nemec has been practicing law in Texas since 2008. Valuable insight is gained through 16+ years concentrating in discrete areas of law. He knows the law. He knows most of the family court judges in North Texas. And he knows many of the other attorneys in Tarrant, Dallas, Collin, Denton, Johnson and Parker Counties and beyond. Mr. Nemec has appeared in well over 40 counties in Texas. You will be in good hands working with Mr. Nemec.

Mr. Nemec suffered a personal tragedy in Spring, 2022 when his wife and mother of his three teenage children unexpectedly passed away. As a result of this shock, Mr. Nemec closed his office for a period of time. He has since grown and focused on raising his beautiful children and building this law practice to be the best it can be. Since October, 2022, we are happy to report that the Law Office of Donald C. Nemec is now more organized, better staffed, and one of the most procedurally efficient law firms in the area.

Donald Nemec is licensed to practice law in all Texas state and district courts, including all federal bankruptcy, civil, and criminal courts for the Northern District of Texas. He primarily practices in family law, but also practices bankruptcy, estate planning, probate, and dabbles in a few other areas of the law.

How We Offer Lower Retainer Deposits Compared to Other Law Firms
Over 16 years, Mr. Nemec has used technological advances to automate and streamline the client experience. Beginning with completing our online questionnaire, scheduling your consultation, and beyond, we use technology to facilitate and simply all legal processes. This advanced system saves money in overhead expenses and allows Mr. Nemec to offer these high quality legal services without the $2,500 - $5,000 down payment retainer fees demanded from most other firms. Mr. Nemec and his paralegal also frequently hold client consultations over the telephone instead of charging the clients for the travel time to meet in person. This arrangement has worked for hundreds of clients and saves on costs, which is directly passed on to you, the client, through a lower retainer payment and a pay-as-you go representation agreement.

Flat Rate per Legal Service Pay-As-You-Go Representation Agreement for your Family Law Suit 
As discussed, I would be willing to provide legal services in connection with your family law matter on a flat rate basis. Instead of asking for a huge retainer deposit and then charging you by the minute for my work, I would agree to assist you with your legal matter on a flat-rate-fee-per-legal-service and pay-as-you-go basis. You will be provided a flat rate quote for every legal service to be provided, in advance of such service being provided. Attorney will provide the legal service after you pay.

  • All payments are due no later than two weeks before such legal services are rendered. If the case goes to a final contested trial, payments for final trial will be due 30 days before final trial.

    • All electronic or in-person court appearances scheduled and lasting less than 1.5 hours will be charged on the following rate:

      • $450 if via videoconference.

      • Additional travel fees of $100/hour from North DFW airport will apply for all appearances.

Be advised that since this is a limited scope, pay-as-you-go service with no retainer deposit to secure future attorney availability, you may be required to sign, in advance, a motion and order for withdrawal of attorney to effectuate the withdrawal of the attorney as your attorney of record if the payments are not made on time as agreed.

Initial $475 Payment
The initial $475 payment is due before our initial consultation begins. You can remit that payment and future payments online with a debt/credit card or e-check. Please visit the payment page on my website for payment information: www.nemeclaw.com/pay.

As discussed, that initial payment covers:

  1. the initial 30-45 minute consultation to be held over the phone; 

  2. legal retention of Mr. Nemec’s legal services on a pay-as-you-go flat rate basis, including document and case registry review, account set-up, file creation and organization, subscription fees, and other administrative tasks that would otherwise be billed by the hour to perform; and

  3. drafting and sending a Proposed Plan of Action to client following the consultation.

You have multiple options for how to pay for your legal service, which include cash, credit or debit card, and installment loans. Neither our office nor any employee have a financial relationship with Affirm, nor do we receive any compensation for providing you with this information. Initial Consultation Meeting:
For your convenience, we may hold our consultation over the phone and save you the hassle of traveling to the Attorney. The meeting will last 30-45 minutes. This time block includes Attorney case-file / document / questionnaire review time. Any additional initial consultation time exceeding 45 minutes will be billed at $300/hour, which fee would be included in your Plan of Action with flat rate quotes statement and due 7 days following the consultation.

  • If you are modifying or enforcing a current court order, I need a copy your current pending court order that is to be modified (not necessary for Tarrant, Harris, Travis Counties).

  • If you have been served paperwork and are hiring me to defend or counter-sue in your case, I need a copy of all documents you were served with, the pending court order currently in place, and if you have been to court, all orders, and other notices of hearing, etc. that you have obtained related to the case (not necessary for Tarrant, Harris, Travis Counties).

  • If CPS has been involved and you have papers from CPS, I need those documents

  • In most cases, you will need to send your last two tax returns and 3 months paystubs as well.

  • Please DO NOT send me evidence at this time, unless previous requested over the phone. We will discuss evidence during our consultation and I may request you to send me a list of evidence you want to use after that phone call.

E-Sign Attorney-Client Contract:
